School Refusal: Legally Responding to School Refusal and Home Hospital to School
The issue of school nonattendance has been on the rise over the last decade, exacerbated in the last year by the COVID-19 pandemic. Nonattendance becomes particularly problematic when it intersects with special education. For students already eligible for services, the question becomes whether the IEP team has the responsibility for providing specific programming to address the nonattendance.
- If it fails to do so, does the school district become liable for failing to provide a FAPE, resulting in possible compensatory education or reimbursement for private school placement?
- For those students who have not been determined to be eligible for special education, does their nonattendance trigger child find and referral obligations?
