School Refusal: Legally Responding to School Refusal and Home Hospital to School
The issue of school nonattendance has been on the rise over the last decade, exacerbated in the last year by the COVID-19 pandemic.  Nonattendance becomes particularly problematic when it intersects with special education.  For students already eligible for services, the question becomes whether the IEP team has the responsibility for providing specific programming to address the nonattendance.

  • If it fails to do so, does the school district become liable for failing to provide a FAPE, resulting in possible compensatory education or reimbursement for private school placement?
  • For those students who have not been determined to be eligible for special education, does their nonattendance trigger child find and referral obligations?
This workshop will focus on several important aspects of nonattendance and its consequences in the context of students with disabilities, including child find and eligibility; addressing nonattendance in the IEP; and nonattendance and placement issues.  This workshop will also cover some of the most problematic issues for IEP teams in determining whether a student requires home and/or hospital instruction and if so, how to provide appropriate services in this highly restrictive setting.
